Terms of Service

Reference copy

This is a reference copy of the Terms of Service as displayed on the Trove platform. If there are any discrepancies, the live version on the platform takes precedence.


1. Acceptance of Terms

By using the Trove gifting platform ("Platform") provided by Elliephant Gifts Group Pty Ltd (ABN 87 659 066 841) ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you must not use the Platform.


2. Eligibility

To use the Platform you can be of any age, except where purchasing liquor in which case you must meet the minimum legal age limit in the jurisdiction in which you reside when ordering liquor products.


3. Services

The Platform enables businesses to send and manage gifts to recipients ("Recipients"). We may modify, suspend, or discontinue the Platform at any time without notice. Trove will use best endeavors to give you timely notice of this event if it occurs.


4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately of any unauthorised use.


5. Orders and Payment

All orders placed via the Platform are subject to availability and confirmation. Prices are in Australian dollars and include GST unless stated otherwise. You agree to pay all charges incurred under your account.

5a. Pay-by-Invoice Functionality

If you enable Pay-by-Invoice (also referred to as Pay-by-Bank-Transfer) as a payment method within your Storefront of the Platform, you authorise the Platform to invoice you for the applicable platform fees associated with any order placed using this payment method.

You acknowledge and agree that:

  • When a Customer selects Pay-by-Invoice on your Storefront, the Customer will make payment directly to your nominated bank account.
  • The Platform will not process the funds related to Pay-by-Invoice transactions and does not collect or hold payment on behalf of you.
  • The Platform will issue an invoice to you for the platform fee applicable to each Pay-by-Invoice transaction, based on the agreed fee schedule or contract terms in place.
  • You must pay each invoice issued by the Platform within 14 days of the invoice date.
  • Failure to pay invoices on time may result in suspension or removal of the Pay-by-Invoice payment option and other services provided through the Platform.

6. Delivery

We aim to deliver gifts promptly, but delivery times may vary. We are not responsible for delays outside our control.


7. Returns and Refunds

Returns and refunds are handled in accordance with Australian Consumer Law. Please contact us for return instructions.


8. Intellectual Property

All content on the Platform is owned or licensed by us and protected by intellectual property laws. You may not use, reproduce, or distribute our content without permission.


9. Acceptable Use

You must not use the Platform for unlawful, abusive, or fraudulent purposes. We may suspend or terminate your access if you breach this clause.


The Platform may contain links to third-party websites. We are not responsible for their content or practices.


11. Privacy

We handle your personal information in accordance with our Privacy Policy, available on our website.


12. Limitation of Liability

To the extent permitted by law, we are not liable for any indirect, incidental, or consequential loss arising from your use of the Platform.


13. Termination and Suspension

We may suspend or terminate your access to the Platform at any time, with or without notice, if you breach these Terms or if required by law. You may terminate your account at any time by contacting us.


14. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform after changes indicates your acceptance of the new Terms.


15. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes shall be resolved in the courts of that jurisdiction.
